Changing to vertical spillover will NOT help EB3 India or China. EB3 ROW is not current and it will suck up all overflow leaving EB2I, EB2C, EB3I and EB3C to their annual quota only. USCIS changing the process to horizontal spillover is the best thing that has happened to I and C community in the absence of immigration reform. Now there is at least some hope for EB3 folks to get a new job and apply in EB2, as at least that queue is faster. If we fight among ourselves and stop vertical spillover, it will only benefit EB3ROW as they will get all overflow from EB1 and EB2ROW. Please guys, let's not fight.

As a precursor to abolishing labor substitution next year, USCIS is increasing its scrutiny of substituted labor. Also there is rampant fraud in labor substituions.
I was reading somewhere that USCIS rejection rate of labor sub is 85% higher than in orginal labor. That is a significant percentage, if you ask me. Make your own decision but be very wary of promises.

Post their name here, no one will ever join him.
File a lawsuit against them..I am sure you may have had emails about his promises or you paying money for GC.

We may think that the debate on illegal immigration has nothing to do with our issues but the corrupt Senators will always try to sneak in some reform related to illegal immigrants into our bills in exchange for their votes, ultimately derailing the entire bill.

Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...
Question remains open:
1. When are they going to increase the GC quota?
2. When congress id going to do something?
I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............

Agree, also Immigration voice needs everyone to join in their cause and support them as Donors and in active volunteering.
New GC applicants generally realize the only way to get relief is through legislative change that Immigration voice is working on.
So rather than wasting time & energy guessing dates, its a good idea to spare 3 bucks a day from coffee for IV and actively campaign for new laws.
BTW the prediction was 1-2 weeks of movement each month for all of 2011, and possibly zero movement sometimes. New Math formulas ,modelling, arent going to change it.
Just look at how many Bills are coming in for Illegal immigration - that is due to active lobbying and generous support of their members.

Anyone invoking AC21 with unapproved I-140?
It is risky to change employers after 180 days before I140 is approved. If it comes to issues, when USCIS realizes one changed employment before I140 was approved, USCIS needs to verify that the underlying I140 was approvable at the time the change of employment occurred. By approvable it means that at that time there was no reason to issue a major type RFE for pending I140. If, for instance, the USCIS notices that at the time one invoked AC-21 and I140 was not yet approved and the I140 petition did not include (or included incomplete) educational documentation, it will say that the I140 was NOT approvable due to material evidence missing. And, at that time AC-21 can't work and may cause huge issues. One should be very wary of this and in general attorneys advise to wait until I 140 is approved before invoking I140.

I have 10 + 2( HSC/ 12th Grade) + 1 (1st year of Bachelors of Commerce) + 3 year Diploma in my field. That being said this is what she has advised/recommended.
She states that she is fairly confident that we can argue successfully the denial. She has said that she will file an MTR/Appeal & at the same time file a new I-140 too. The advantage she said of filing a new I-140 at the same time is that she can make an airtight case with the cover letter covering the points for the reason for the denial of this I140 & the decision on the new I-140 would be fairly quick if the appeal is denied as it was filed witht eh appeal for the old one. The only disadvantage with a new I-140 would be that we cant file for 485 till there is an open visa, which means no EAD/AP for myself & my wife.

Will I-485 package get rejected if no employment letter attached?
While rushing to send our packages to USCIS on July2nd, we could not get our future employment letter signed and did not include in the package. But now I have the employment letter.

A lot many can empathize with you. But if you are looking for relief - you ought to take responsibility for how you feel. You already understand the forces of nature - you will get your GC when it's your time. If anything your needless frustration and forceful attempts are only interfering with the energies that have made your PD current.
Just relax - get some exercise, eat well and participate in things that lift your soul.

I know before you start blaming me for this thread, as it is of no use, I would like to point out that most of you must be experiencing the same thing. I didn't care much for Visa bulletin until it became current for EB2 two weeks back. As the time progress, I am doing all sorts of things, like checking USCIS case status, and checking everything that can possibly give me some information. I know that it is waste of time, I know it is not good for health, I know that I will get GC when time comes, but still, my mind is tricking me to think about it. I checked all these forums until 2A.M last night. I am not having enough sleep. I am waiting for a opportunity to get rid of my desi employer. I am really getting frustrated (I am not saying that I have been waiting for GC approval desperately). I just want to share my frustration and what I have been going through. I know I am in a better position than most of other people whose priority date is not even current. I wish they never dangled a carrot in front of me. I am not sure if they disappoint me next month, but I am still keeping my hopes. Hopefully, I would get over this and have enough sleep from today.

Hi, I got two "receipts":
Number 1: received date: July 2nd and notice date: September 4. Receipt number: WAC-XXXXXX, It was sent from CSC
Number 2: this is a "transfer notice" with Receipt Date Aug 31 and Notice date September 7th. It said that my case had been transferred to NSC because I reside in the NSC jurisdiction. Please note that I sent my application to NSC to begin with...
Strangely, the transfer notice was also sent from an envelpe with CA stamping.
So I called yesterday and asked why the case was transferred back and forth and whether the delay in between affect my sequence in the processing time.
Answer: 1.Why did it get transferred? Because NSC center is overwhelmed and need help from CA center. Then CA center was overwhelmed so the case has to go back to NSC.
2. Does the delay affect my sequence in the processing time?
NO, the "Received Date" of July 2nd is recognized.
My thoughts: You can call and verify the information. My first call got to a woman who did not know what she is talking about.:mad: I had to call the second time. Please share your info if you had called or will call. USCIS is unreliable and random. We need to verify a couple times and see whether the answers are consistent--this has been my strategy dealing with them.
