I also had a business trip conflict with the DC Rally; however I decided to talk to my boss and explained him about the Rally. He immediately agreed upon and allowed me to postpone my business trip.

We spent approxiamtely $4000 not including the filing fee which is another $1500 approx.

All i can say for you is angoor khatte hain(grapes are sour for you) since you didnt get it.
This is what happens to jealous people.
Anyways, we have played by the rules.
What do you say about people getting GC by lottery.
Go and blame the govt for the rules not us.
I don't care about LS. Almost all cases I know are fraud. Sometimes 2 guys got GCs on same labor(since they were not asking Original LC). Thank god USCIS banned LS.

We filed our AOS, EAD and AP on Aug 13th at NSC. We are from Santa Clara county in california. I heard that people from santa clara are getting FP's very late?
We have got our Receipts on Sept 30 and EAD on Oct 28th. No FP and AP yet.
My question is how to create service request?
We are planning out of country. Just waiting for this FP to be done.
Can we postpone FP for a specific period of time?

If someoe is on H1B then he converted to H4. Then He converted to H1B.
He didnot leave(USA) the country any time. How his time calculated.

I also sincerely believe that Nothing is going to happen I say, these senators are doing CYAs; they will bitch it to media, their constituents, hey look, we did attempt these immigration reforms.
I am talking from my long experience and wisdom and take it from me. The only force that can improve the pitiable conditions of Indian and Chinese due to retrogression and lack of visa numbers is the big corporate employers . Each one whose LC is approved, whose I-140 is approved, who is waiting to file for adjustment of status AND who are indispensable to the employer / work at this stage should write to the HR/ Immigration/ Attorney.
I am in such a position. I am a technical lead in my IT department. PD Nov 2001. I write about these issues and the difficulties once in a month my team manager, or project manager or Immigration department.

I got the scanned copy of the RFE of my wife's case from my attorney this morning, here are the details - "Need secondary evidence to demonstrate the claimed relationship..."
I had submitted the marriage certificate, but now they want more. Gurus, has anyone received something like this before, please suggest how this can be taken care of. Can someone point me to a sample affidavit, please?

It says some applications will still be delayed . I assume of one is stuck with namecheck where FBI is waiting for response from native country, he will be waiting for eternity. Nowhere it says applications will be approved while the namecheck is pending.

I am traveling this month end to India via Frankfurt. I am on AP. I checked with German consulate in US and officer told me we need transit visa both ways (going and coming back). there are no exceptions. He confirmed the same twice when I went in person to get Transit visa.
I would rather listen to German consulate office rather than interpreting stupid sentences on German consulate web site. So please do get Transit visa with 2 entries.

Nevertheless, I did not take transit visa, and with visa stamping expired in March 2010, I travelled with AP on Lufthansa from IAD to BLR in December, and returned in Jan 2011, and nobody even mentioned the word "transit" anywhere along the route. Lufthansa staff is very knowledgeable about AP, both in Wash.Dulles and BLR. In fact, In BLR I saw that even Air France also does not require transit visa for Paris and allowed people with AP to board without transit visa. So folks, dont waste time and money on transit visa. India rejected both Boeing and Lockheed Martin's proposal of fighters . I am not debating the reasons or the merits of this decision if this was right or wrong . I am just discussing the potential repercussions this has had so far and might have .

1) The issue is so serious that Tim Roemer , US Ambassador to India submitted his resignation immediately since he was on the hook for making this deal work .This shows the measure of disappointment they had.
2) India was seeking US assurances in security a Permanent Security council seat , which looks far fetched now .
4) Pentagon , Whitehouse and the DoD very upset that deal fell through . This sentiment will certainly percolate to the USCIS and the State department and might embolden Anti Immigration senators whose measures will get more support in the house and senate.
5) Prosecution of companies entangled in cases like Infosys might find more support and favor with the Govt.
Question is how/if there will be a backlash against India / Indian's get back at us at least in the short term .Increased scrutiny and visa denials , PoE Harassment , GC audits etc.
Will the US take a Tit-for-Tat reaction on this issue is what remains to be seen.

I disagree with the first part of your statement. There are no guarantees in life. But, giving unsolicited advice especially without knowing what happened in their marital life is no good. Only he and his spouse would know what happened and it is completely up to them to decide what is good for them. He has clearly told in his post that he has given his best and it is at a point of no return. Only people who go thru this grueling experience can understand how hard it is.
