It is fishy, but nothing to worry about. It's illegal for an employer to impose early termination fee in any form so even if you sign it, this clause has no power.

Cornyn Calls on Obama to Present Immigration Reform Plan - Roll Call (http://www.rollcall.com/news/36174-1.html)
Cornyn Calls on Obama to Present Immigration Reform Plan
Sen. John Cornyn (R-Texas) on Tuesday called on President Barack Obama to come up with a comprehensive immigration plan this year, saying a directive from the White House is the only way to push the complex issue forward.
What we need is not another photo op at the White House. What we need now is a plan from the president, said Cornyn, ranking member on the Judiciary Subcommittee on Immigration, Refugees and Border Security.
The president doesnt write legislation, but he does have the bully pulpit, Cornyn said, adding that right now its unclear how they can get it finished.
Cornyn is one of several lawmakers who will meet with administration officials Thursday to discuss immigration policy. White House spokesman Robert Gibbs acknowledged Monday that time may run out this year before the administration and Congress already spread thin with health care and climate change legislation can take up yet another time-consuming and sweeping proposal.
Minority Leader Mitch McConnell (R-Ky.) echoed those concerns: Weve got a full plate already.
Theres been little discussion from our side on immigration reform. Ive honestly not given it a lot of thought, McConnell said.
But Majority Leader Harry Reid (D-Nev.) reiterated his call for doing a comprehensive immigration reform bill this year.
We have to finish health care and climate change, but being third on the list is pretty good, Reid said, predicting that he could muster up the votes for a bill later this year.
Sen. Charles Schumer (D-N.Y.), who chairs the immigration subpanel, will deliver an address on immigration at Georgetown University on Wednesday and is expected to outline the principles that will guide legislation he intends to introduce in the Senate later this year, according to a release.
Schumer will also attend the White House meeting Thursday.

This is horrible and some community organizations and law firms must talk to the DOS/Whitehouse about this issue. National Security is must but there must be better way than playing with the future of so many innocent people (99% most likely of which will have acceptable backgrounds).
You must have already done some of this - try to contact your local Congressman, Attorney, Employer and try to find more info. This is completely unacceptable. After the PIMS introduction, I am hearing a lot of horror stories. It never used to be so bad earlier.
How can the consulate keep passports for so long? Basically, they are even barring you from taking any journey anywhere abroad. Why?
National security and background checks are a must but with someone who has been in US for 5+ years (or for that matter even once) should already have been verified.
I am assuming you do not have AP or do not want to use it...otherwise you can ask for your passports, abandon the visa application and enter US using AP. Talk to your attorney if you try this..

But he doesn't have any voice,,,
Says who?
We don't even advocate for anything, just post things on the forum. IV has given us immigrants a platform - many of us don't even know it, let alone using it.
If we want to stay in this country, we need a president who can take this country progressively to the future instead of "lets take the country back" "this is not the country I grew up in" rhetoric! If this country goes backwards in time while the rest of the world embraces progress - guess what? - No use having a GC here.

My company paid for attorney fees. I dont know the amount for that.
My pocket expense
$380 - medical tests
$60 - photographs
$50 - mailing fees.
Obviously, no money can account for the mental torture I and my family have been going through once we learned about visa bulletion revision rumors.

Seems like most of you guys have grudge against Andhrites (GULTIs that you call us with love). Agreed that most ppl who come to this univeristy are from AP. There are about 900 students in this university, but there are thousands of students from AP that are studying in other reputed university. I'm one of them.
I'm not sympathetic towards the ppl who are facing deportation. But i strongly condemn the way they are treated. Tying the tracking devices to their legs and treating them like terrorists is totally inhuman and insane

Actually, the numbersusa website makes mention of SA 2143 (John Cornyn) of HR 1585,(currently being debated) which according to them allows for recapture of unused EB visas from 1996 and 1997.
Dont know if it is true or not, they are encouraging their folks to lobby against it.

Sorry to hear about your situation. You should've taken unpaid leave for two weeks instead of a lay off. Now you definitely should not file AC21 and hope that the USCIS will not issue RFE (rarely happens). It doesn't matter how you quit, if the USCIS finds about it, it will probably deny I-485.
Regarding Shusterman's Q&A. I am not sure where he is coming from. The law (8 USC 1154) does not provide for lay-off exception. Wait... The USCIS memo says this:
"Question 10. Should service centers or district offices deny portability cases on the sole basis that the alien has left his or her employment with the I-140 petitioner prior to the I-485 application pending for 180 days?
Answer: No. The basis for adjustment is not actual (current) employment but prospective employment. Since there is no requirement that the alien have ever been employed by the petitioner while the I-140 and/or I-485 was pending, the fact that an alien left the I-140 petitioner before the I-485 has been pending 180 days will not necessarily render the alien ineligible to port. However, in all cases an offer of employment must have been bona fide. This means that, as of the time the I-140 was filed and at the time of filing the I-485 if not filed concurrently, the I-140 petitioner must have had the intent to employ the beneficiary, and the alien must have intended to undertake the employment, upon adjustment. Adjudicators should not presume absence of such intent and may take the I-140 and supporting documents themselves as prima facie evidence of such intent, but in appropriate cases additional evidence or investigation may be appropriate."
So you may not be in a bad shape after all. As for whether to file AC21 papers in your situation, I am not sure. I would not do it.

I am the primary applicant. I am planning to get married in next 1 year or so with a girl from India. If I get my GC then she will fall under family based which will take years for her to come here. I do not mind moving back if that happens.
Since I have valid H1 can I do something,
There is no reason for you to pull out your 485. Get your divorce expedited and get married quickly and you should be OK as EB3 India is not really moving forward unless there is a visa recapture or something like that.
Your spouse will of course lose her 485 and will have to start afresh. But I assume she already knows this and is OK with that.
