    Education required: bachelor degree in computer science, engineering,
    electronics or related field. Experience required: 9 months as Software
    Engineer.

    Any idea what Onet code the above description falls under?

    I am planning to take up Java developer position with new employer using EAD. is it ok? Lawyer has been saying that the job description has to match 100%. I dont agree with him. any comments please?.

    go easy on him/her!! they are doing whatever they can LEGALLY to get their GC. If the practice is unfair, blame the people who put this into place.

    what is right and what is wrong is very difficult to decide without being aware of the context?

    as far as ethics are concerned, we are in business here. there is LEGAL and ILLEGAL. everything else IMHO is hogwash.

    Congrats suresh..it's good to see Dec 05 getting approved..best option would be to get your wife here on F1..Some of the schools required only TOEFL ..after coming to US get married again in US and apply for 485..if she is currently working in india..u can try L1 too....ofcourse for H-1B u need to wait for one more year..i don't think US embassy in Chennai will get to know u got married unless she tells them..there is no fraud or anything in this..i believe it's like..don't ask, don't say..ur not cheating anyone..trying to find a small loop hole for a very good reason..

    Well, what is the point in saying it now, he should have said it in the 90s and early 2000 when industry was booming and people found a career path in coming to the US.
    Right now, so much work is outsourced and it is continuing. Very difficult to get a IT job in US on h1b and IT consulting on h1b also facing so many hurdles. For any new immigrant on a software job who wants to get a h1b visa and green card - it is not an easy task.

But their lives could be made easier by providing schools, making sure that power condition and commuting is reasonably all right " Looks like he wants to still have the "less expensive" advantage over non-Indian companies / competition and he just wants more and easy H1B's and does not like the path to permanent residency and eventually citizenship and integrating with the American society - which is what American immigration is for. Just need the $$$. Though there are many good to learn from this company and this man, I do disagree with his views when it comes to immigration to USA.

    The kids from the second marriage can definitely come. He can call the first wife get her the green card, then divorce her and go and marry the second wife and bring her here.

    once he gets his GC (until he becomes a citizen) getting the 2nd wife over iis going to take too long, as its in FB quota, not EB. Thats one reason why many unmarried folks did not file their I-485 in July/August. If their 485 is approved before their marriage, then bringing the spouse over is real tough.

    If the sale takes place, it probably will be bought by either a Chinese or Indian company. Some dumb anti-immigrationists will try to block legal migration every possible way when most of their companies are either taking jobs overseas or getting sold to foreign companies. Go and find the source of what has destroyed the economy and try to fix it. No foreigner has ruined the economy.

    I think, there is no harm in calling the cops and let them know what has happened to be on safer side. Especially when you provide them your address, Did you by any chance?

    Let them investigate it and find out what is going on. If you want, you can also file a complaint with FTC for phone fraud.

    I am a PMP certified and I know how much it makes a difference in my working now and then..
    PMP is a methodology with standards if followed to its best, you will never have a derailed project or dissatified clients and management. The biggest difference I was when my VP was trying to execute a migration project and slipped 3 deadlines. When I stepped in I simply started putting up the things in place the way PMP recommends and got everyone in line and guess what, on dec 11 the migration of the complete system and application from one datacenter to the other completed. I got commendation etc etc etc .. from senior management and they said none of projects have been executed so smoothly as this one..

    Thats another story after 3 months I got lay off. Anyways PMP is very very very important, its not about managing people , its all about managing the Project. Most of the guys have the misconception that when they become the PM they will have 2-5 guys reporting to them and one will be the "BOSS". Thats not PMP means, I have done Project management without anyone reporting to me, actually I was treating the team as they are my boss and keep every thing and everyone in line in terms of the Project execution. Reporting and stuff happens in the functional organization with functional managers, in projectized environment everything is adhoc. once the project is completed everything dismantles and the project management is nothing but just a tool.

    You will come to know the value of Project management when one will work in 20-50 million $ projects and how PMPs help keeping everything so simple and straight.

    This is an excellent question Rahul. I have tried my best to find a definitive answer to this question. Different experts/lawyers have given different answer to this question. So I am not sure if salary hike at the same employer would hurt AOS application in anyway. On the face of it, it should be a no brainier and we would like to hear that. Most of the times, we all want to hear our lawyer give us a specific reply, so even if they lawyer is telling us something which doesn't directly imply what we want to hear, we still think that that the lawyer is telling us what we wanted to hear - "selective hearing".

    But some lawyers have told me that substantial salary increase (30% in 3 years can be seen as substantial) could be a problem at USCIS. They could argue that the job/job requirement/job responsibilities have changed substantially as there is a substantial change in the wage rate offered. So it�s a grey area. In effect, system is designed to keep us where we are till the time the green card petition is approved. I realize that this doesn't provide a definitive answer to your question and sorry about that, but this is as much as I could find out about the specific question.

    I have a question on salary hike after invoking AC21.
    What if new employer pay same salary as old and the other amount as per diem. Is that going to be a problem.
    For ex. current employer is paying 80K and new employer is going to pay 120 K. Which is way beyond the limit. In this case can new employer pay the difference in per diem.
    Experts, your opinion please.

    This is not to oppose your message - I am just trying to figure out where these arguments comes from because I don't think I believe in this whole fraud thing. AC21 is meant for one to change jobs after working for the original sponsoring company for 180 days. Also, there are no clear guidelines stating that one must inform the USCIS - so what will this fraud be based on? How can one be committing fraud if there are no guidelines to tell you what is considered fraudulent? I think one is fraudulant when one actually violates some set rules etc. I don't think the USCIS can have a basis for suspecting someone of fraud when they don't even have a definition of what may constitute fraud in this case because of the lack of guidelines. Plus, I have never, ever heard of anyone be denied or suspected of anything like this during citizenship, I just don't believe this is a factor AT ALL. I see these comments a lot and they just don't make any sense to me. To me, it is like breaking a law that doesn't exist. And you say one may be "suspected", well, suspicion is just that, suspicion. The USCIS needs to show proof that you intended to be fraudulent and for as long as there are no AC21 guidelines that tell you that you must inform the USCIS upon invoking AC21, the USCIS will not and cannot have a case against you.

    The disadvantage of not filing for AC21 is if your AoS is approved with USCIS believing that you will be working for the original petitioner after approval.

    That is the disadvantage. USCIS will not know that you intended to port to new employer by invoking AC21 and come the time your apply for Naturalization, USCIS will discover it and may suspect you of fraud.

    As per the memo if the I-140 petition was approvable at the time of filing, one should be fine even if employer tries to withdraw unapproved I-140.

    If there is an RFE, then sure things are messy if employer does not cooperate.


    If you try to use AC21 without an approved I-140 your employer can withdraw the I-140 petition ( since it is not approved yet ) . So best wait a few months until it is approved and then merrily go the AC21 way

    As a PMP who works in a large corporation let me give you another side of the story.

    1. PMP certification can get you a PM job and boost your earnings but if you hate having to deal with lots of people PM job is not for you.
    2. PMP is for large projects in large corporations. If you like working in fast paced tech companies stay away from PMP. Basically PMP is meant to manage all the fluff that exists in large corporations.
    3. Also, be ready for insults from technical staff. They treat PM's like idiots and quite frankly a lot of PM's are merely schedule jockeys. Very few PM's are true to their profession.
    4. Bottomline: $500 is worth the investment. Do not shy away from it if you like PM kind of work.
