I would be delighted since I am from EB3-I. That is what is unfair about this country cap. You probably filed your GC in 2009 and is already impatient. Think about people who came to this country in 2000 or before still waiting for their GCs.
Some of them has aging out kids who will lose their eligibility because of this long wait.

The more the evil called 'Labor Subsitution' is alive, the more grief we are gonna get. Especially EB-3's. BEC's are chruning out labors, I'm sure 50-60 % of the benificiaries have moved on. But there approved Labors are being sold openly. I'm guessing there are atleast 30-40K EB3 India in 2001-2003. You can Imagine How any years it'll take for the dates to cross 2003 Dec. My calc is

By the way, AILA reports the bill numbers for the Dream Act as follows (the bills were introduced in both house and senate)...S. 774 and H.R. 1275...it doesn't mention anything about being below 30, z visas, or being undocumented...!!!

Transit Visa need to Travel Via-Germany if you don't have valid Visa or Travelling on AP.
Please who are travelling Via---> Germany should hold Transit visa, if they don't have Valid US Visa or using AP.
I believe this rule came recently, please see below link of German Consulate Website for more information.

This applies to people who are going to India to get Visa at Consulate in India too.

I believe pre adjudicated means, most of the processing is done, and waiting for the visa number availability.
Nothing will happen for you on the info pass, hopefully you will come back with a good news.

Just a query how did you came up with the date of April 2005.
april 2005 would equal a 1 year movement for India EB2 from the june bulletin.

Guys, let us not get carried away. The Immigration and Nationality Act clearly says that the Attorney General shall give Employment Authorization to people with pending Adjustment of Status. It is just the duration of the EAD that is left with the discretion of USCIS.
People keep throwing around the phrase "Administrative solution". In this country, just about everything is codified by law. Some things, like the EAD duration, can be tackled Administratively. However, USCIS isn't going to give up a cash cow, viz. the fees from yearly EAD renewals, easily. It is a lot easier to have Congress mandate three year EAD extensions than to convince USCIS to do it.
I guess the argument that BKarnik is trying to make is that USCIS should be administratively mandated to give Employment Authorizations to people with approved immigrant petitions. However, in the last few months, I have been looking at INA on a regular basis. Most immigration practices are codified in INA, and I would be really hesitant to even ask for an administrative fiat to this effect. You call it cynical. I call it realistic my friend. If it makes you "feel good" and thats why you support the idea then fine. However the thread was started stating this is somehow good for our money. I am not convinced.
My point is, firstly this is a far way from fruition, and even if it happens there will be a queue of gov't bureaucrats lining up and licking their chops to meddle with it. Furthermore the leftist parties there will ensure that every socialist policy in the books will be applied to your so called retirement funds. A steady revenue stream of that magnitude will not be left in peace. That much I can assure you.

1. marriage certificate
2. wedding photographs
3. wedding card invitation
4. property papers on joint name
5. other investments on joint name might help.
6. Indian passport has spouse's name entered
7. "Lease papers"
8. "Medical insurance papers with name of the spouse"
9. joint tax filed as additional proof.
10. Her H4 stamping etc can be a proof too
I am now trying to come up with a affidavit format that I need to send to some folks in India who attended our wedding and get those too... I will keep you all posted..

I think this has a better chance than rest of other EB bills, because US wants more skilled persons and by defintion advanced degree holders from US in STEM are. Congress extended 20,000 H1 visa for US masters and PhD graduates some years ago whereas they were and are loathe to extend the total H1 numbers.
Going by this logic, I think this bill will go farther and gain traction. Lets's keep our fingers crossed.:)

No surprises for me at least. There will be only 816 new EB3 visas available for any country in October. This will move the dates at the most by a month or two and this will continue for ever until a new legislation is passed, that is why DC rally is all the more important and everyone should focus on that to bring in a change.
For folks wondering how I came to the 816 visa number
Total GC available = 140000
7% country limit = 9800
split for EB3 = 3266
spread for each qtr = 816
Good Luck to all and don't have high expectations because you will be disappointed when the bulletin comes out.

1.Apply for new H1 petition(premium processing) for you before July 31.
2.On approval send the H1 papers to your wife so that she can get H4.
3. On her entry to USA apply for her I-485.
Then you can live happily together in america.
P.S: Even when you have used AC21, in hindsight you should have got H1B instead of using EAD.

I read the document and here's what I think is the important part:
In a subset of these
case, the FBI name check request that been pending for more than 180 days.
This means that only a part of those 47k applications are pending for more than 180 days. This doesn't say they will approve 47k in March.
Why mid March? Well that's the time of the month when the VB will be published so I'm curious to see how the April VB will look like.
